HC Order on Disqualification of 8 MLAs Challenged Before SC; Likely to Be Listed This Week

New Delhi: After a delay of over 700 days by the Goa Assembly Speaker in deciding disqualification petitions filed by Girish Chodankar against eight defectors, Chodankar has challenged the Speaker’s order before the Supreme Court, seeking the disqualification of the eight MLAs who defected to the BJP after being elected on the INC symbol.

The petition has been registered and is expected to be listed before the Supreme Court in the coming week.

Given the recurring instances of political defection, the petition is expected to play a key role in upholding democratic values and reinforcing the electorate’s mandate.

The case holds significant legal importance, as it challenges the interpretation of the Tenth Schedule (Anti-Defection Law), particularly concerning the defense of merger. With divergent rulings from various High Courts, a Supreme Court judgment is expected to bring clarity and align with the objectives of the Anti-Defection Law.
