Panaji Police station attack case: Aires Files Caveat in SC

Adv. Aires Rodrigues has today filed a caveat before the Supreme Court in the 2008 Panaji Police Station attack case.

Anticipating that the accused Babush Monserrate and Jennifer Monserrate may move the Court to try and deviously stall their trial, Adv. Rodrigues has in his caveat application prayed that no order in any petition filed by them be passed without hearing him and if possible through video conferencing in view of the current COVID situation.

In his application Adv. Rodrigues has also drawn the Court’s attention that despite the High Court order dated 24th April 2012 declining to quash those criminal proceedings they managed to get an order from the High Court on 4th December 2014 staying the trial.

Adv. Rodrigues in his caveat application has also drawn the Supreme Court’s attention that the trial has been stalled for seven long years despite the fact that any stay granted by the High Court expires in six months unless extended by the Court.

Pointing out that the law requires that criminal cases against politicians be expedited, Adv. Rodrigues in his application has stated that it was an irony that the law breakers have continued as law makers with this very serious criminal case against them languishing so long in cold storage.
