Beleaguered Goa Deputy Speaker Isidore Fernandes suffers another jolt

A Division Bench of the Bombay High Court at Goa comprising of Justice M.S.Sonak and Justice M.S.Jawalkar today declined to grant any interim relief whatsoever to Raymond Filipe Fernandes, the now controversial son of Goa’s Deputy Speaker Isidore Fernandes who has been finally axed from the list of those selected for the Awal Karkun’s post at the North Goa Collectorate.

The Court in its order observed that the BA degree submitted by Raymond Fernandes was from a University not recognized by the University Grants Commission.

On 27th May from the list of those 16 who were selected in January this year for the post of Awal Karkun, Raymond Fernandes was left out and the other 15 were allowed to join work, while Raymond Fernandes was served a show cause notice on 14th May by the North Goa Collector as to why his candidature should not be cancelled for having submitted a BA degree from Bhartiya Shiksha Parishad Lucknow which is a fake University.

Raymond Fernandes in his reply contended that once selected he could not be denied the job, but the North Collector held that the explanation given by Raymond Fernandes was not tenable and  directed that his selection for the post of Awal Karkun now stands rejected.

Following Adv. Aires Rodrigues’s complaint to the Chief Secretary in February this year seeking a thorough probe into the selection for the post of Awal Karkun, the North Goa Collector had asked the Registrar of Goa University to verify whether the degree submitted by Raymond Fernandes was genuine while the whole selection process was kept on hold.

The Registrar of the Goa University in his reply informed the North Goa Collector that the BA degree from the Lucknow based Bhartiya Shiksha Parishad submitted by Raymond Fernandes was from a fake University.

The Registrar of the Goa University also drew the attention of the Collector that the University Grants Commission by a notification dated 30th June 2016 had notified the list of fake universities which included the Lucknow based Bhartiya Shiksha Parishad. The Registrar also sent the Collector a copy of the judgment of the Madras High Court delivered on 22nd September 2017 and that of the Calcutta High Court pronounced on June 19th 2018 holding that the Bhartiya Shiksha Parishad was a fake University.

Adv. Aires Rodrigues earlier this week met the Goa Governor Satya Pal Malik seeking his directions that an F.I.R be filed against Deputy Speaker Isidore Fernandes’s son Raymond Fernandes for having submitted a fake BA degree from Lucknow based Bhartiya Shiksha Parishad while applying for that post of Awal Karkun.

  1. The issue involves an individual who has submitted a document in proof of educational qualification from an unrecognised University at the time of selection
    Following this he has been axed from the list of selected candidates to the vacant/new post of Aval Karkun Govt of Goa
    The next step would be for the Govt to file a case against him for misrepresentation of facts. Similar action should also be taken against those both on the shortlisting panel / interviewing panel who relied on the document
    If the concerned authorities refrains from doing so; the same can be
    brought to the notice of CS for necessary action, or the Governor, or the Court of Law either by a public spirited citizen or any of the interviewees who did not qualify
    There appears to be no reason to draw the incumbent to the office of Deputy Speaker despite his personal relation with the individual unless there is a figment of proof that he indeed corroborated with the government officials to overlook this irregularity.
