Panaji: Former Tehelka editor-in-chief Tarun Tejpal surrendered before a Goa court on Monday to serve his 10-year rigorous imprisonment sentence in a 2013 sexual assault case, after the Supreme Court declined to exempt him from surrender.
Tejpal surrendered before the Additional Sessions Court at Mapusa, complying with the direction of the apex court, which had said that his appeal challenging his conviction and sentence would be considered only after he surrendered and submitted the required surrender certificate.
He was sent to the Central Jail at Colvale in North Goa on Monday, immediately after his surrender, to undergo 10 years of rigorous imprisonment.
The Goa Bench of the Bombay High Court, on August 6, 2026, overturned Tejpal’s 2021 acquittal by the trial court and convicted him in the case involving a junior woman colleague.
The High Court subsequently sentenced him to 10 years of rigorous imprisonment. It also imposed a fine of more than ₹10 lakh and directed that the amount be paid to the victim.
The case dates back to November 2013, when the woman journalist accused Tejpal of sexually assaulting her inside a hotel elevator during an event organised by Tehelka in Goa.
Tejpal was arrested in November 2013 and remained in custody for several weeks before being granted bail.
The Goa Police filed a chargesheet against him, accusing him of offences including rape, sexual harassment, wrongful restraint, and wrongful confinement under various provisions of the Indian Penal Code.
The trial was conducted before the Additional Sessions Court at Mapusa.
In May 2021, the trial court acquitted Tejpal of all charges, holding that the prosecution had failed to establish the case beyond reasonable doubt.
The Goa government challenged the acquittal before the Bombay High Court, contending that the trial court had erred in its appreciation of the evidence.
After a prolonged hearing, the High Court, on August 6, allowed the state’s appeal and set aside the acquittal.
The High Court convicted Tejpal under several provisions of the IPC, including Sections 376(2)(f) and 376(2)(k), relating to aggravated rape, besides offences under Sections 354, 354A, 354B, 341, and 342.
While reversing the trial court verdict, the High Court placed considerable reliance on the testimony of the woman and other evidence, including CCTV footage and emails exchanged after the alleged incidents.
The High Court also criticised the trial court’s approach towards the conduct of the complainant, saying that a survivor of sexual assault cannot be expected to behave according to stereotypes of an “ideal victim”.
The High Court rejected Tejpal’s defence that the allegations were part of an attempt at extortion or character assassination and held that his position of authority over the woman was relevant to the case.
Following his conviction and sentence, Tejpal approached the Supreme Court challenging the High Court judgment.
The apex court, on August 25, directed him to surrender within the stipulated period and said his appeal against the conviction and sentence would be taken up after he complied with the surrender requirement.
Tejpal had sought exemption from surrender, but the Supreme Court refused to grant him such relief. The court subsequently indicated that his appeal could be listed for hearing after the surrender certificate was submitted.
The Goa government, meanwhile, has also approached the Supreme Court seeking enhancement of the sentence, arguing that the 10-year punishment awarded by the High Court was inadequate and seeking life imprisonment.
The surrender on Monday marks the latest development in a legal battle that has continued for nearly 13 years and has seen two substantially different verdicts — the 2021 acquittal by the trial court and the 2026 conviction by the High Court.
Tejpal’s challenge against the conviction is still pending before the Supreme Court, and the apex court is yet to decide the appeal on its merits.
