Panaji police verifying complaint filed against Goa Deputy Speaker Isidoro Fernandes over his Portuguese nationality

The Panaji Police have commenced examining the complaint filed by Adv. Aires Rodrigues against Canacona MLA and Deputy Speaker Isidoro Fernandes over his alleged Portuguese nationality.  Alleging that Isidoro Fernandes had committed criminal offences amongst others under the Citizenship Act, 1955, and Section 177, 181, 419 and 420 of IPC of the Indian Penal Code and under the Representation of People’s Act, Adv. Rodrigues in his complaint  sought that a F.I.R be registered against Isidoro Fernandes and that it be speedily investigated without fear or favour whatsoever in accordance with law.

Adv. Rodrigues has stated that if the Police attempt to shield Isidoro Fernandes by not registering the F.I.R he would be compelled to move the Court on the failure of the Police to uphold the Rule of law.

Pointing out that Isidoro Fernandes is a Portuguese National and not an Indian Citizen, Adv. Rodrigues in his complaint has further stated that the birth of Isidoro Fernandes was registered in the Civil Registration Office of Beja in Portugal as Assento de Nascimento No.2043/2014 on 22nd April 2014 and has also given the Panaji Police a copy of the Portuguese Certificate obtained from the authorities in Portugal.

Adv. Rodrigues has also stated that information sought from the Conservatoria dos registo Civil de Beja makes it amply clear that Isidoro Fernandes is a Portuguese National and not an Indian citizen.

Stating that foreigners are not entitled to be registered as voters and vote in India, Adv. Rodrigues has stated that only Citizens of India are entitled to be registered as voters and that  Isidoro Fernandes has been illegally staying in the country and now holding constitutional positions.

Adv. Rodrigues has further stated that Isidoro Fernandes is by Indian law prohibited from holding constitutional positions representing a Government of which he is not a citizen and that this misrepresentation attracts penal action against Isidoro Fernandes.

In his complaint Adv. Rodrigues has submitted that Isidoro Fernandes was also getting monetary benefits from the State Government now as MLA and Deputy Speaker besides drawing pension for his earlier terms as MLA and that this amounts to gross violation of the very law itself and that Isidoro Fernandes has committed a mockery of law and the authorities.

Pointing out that as per Section 7B (2) (f) of the Citizenship Act, 1955, which was incorporated in the Citizenship Act, 1955, by Citizenship (Amendment) Act, 2003, which came into force from January 7, 2004, an overseas citizen of India is not entitled to the rights conferred on a citizen of India under Section 16 of the Representation of the People Act, 1950, in regard to registration as a voter., Adv. Rodrigues has stated that Isidoro Fernandes holds an Epic Card being enrolled in Canacona Constituency at Serial No 573 in Part No 30  and has also illegally exercised his franchise even at the recent 2017 Assembly elections.

Adv. Rodrigues has also submitted that Isidoro Fernandes is illegally registered as a voter in the electoral roll of the State of Goa and that it was obvious that Isidoro Fernandes has misrepresented himself to be a citizen of India and obtained illegal registration as a voter in the electoral roll.

Adv. Rodrigues has stated that Isidoro Fernandes who is a Portuguese national since the April 2014,  has suppressed his Portuguese Nationality and managed to have his name continue illegally in the electoral roll, and fraudulently and dishonestly made use of the illegal entry in the electoral roll, to pose as an Indian citizen.
