JMFC directs Anjuna Police to produce case diary on assault at Vagator Nightclub

Mapusa Judicial Magistrate First Class (JMFC) Ashwini Khandolkar has directed the Anjuna Police to produce the case diary pertaining to the investigation into the grievous assault on two brothers Anish and Aditya Varshnei by around ten staff of the night club ‘Raeeth’ in Vagator on the night of 12th November.

The Court direction came after Adv. Aires Rodrigues representing the Varshnei brothers submitted that the police were not properly investigating the case and were shielding the accused.

In the petition before the JMFC it has been submitted that though a oral complaint was made to the police on 13th November 2022 around 12 noon followed by a written complaint the same day at 5 pm against the staff of the night club Raeeth for that grievous assault, an F.I.R came to be registered only on 14th November 2022 at 19.47 hrs against ten unknown persons. It has been further submitted that one of the brothers suffered severe injuries on his face and could have even lost one of his eye.

The Investigating Officer PSI Francisco Xavier in his reply filed before the Court has stated that the case is being investigated in all angles with efforts being made to trace the accused while notice has been issued to one accused Vinay Tupkar to be present for investigation and that superior officers are closely monitoring the case.

The Court will on 7th December hear arguments on the plea by the assaulted brothers that directions be issued to the Anjuna Police to properly investigate the case and that the Court monitor the investigation as the accused are very influential . It has also been sought that the Police be directed to submit a weekly status report on the investigation of the case.
