Panaji: The Division Bench of Bombay High Court at Goa has issued notice to the member secretary (MS) of the Goa Coastal Zone Management Authority (GCZMA) Parag Nagarshekar in a contempt petition filed by a senior citizen for failing to perform the public duty.
The notice issued by Justice Prthviraj Chavan and Justice NM Jamdar on June 7 is returnable by June 19.
The Court is also contemplating a disciplinary action against Nagarcekar for nonperformance of public duty and for failing to adhere to Court directives.
Caetano Jose Fernandes had moved High Court with a contempt petition against the Member Secretary for failing to consider his application for reconstruction of his residential house in December 2015. Nagarcekar in a statement before Court, in a Writ Petition filed by Fernandes, had assured to consider the application within six weeks. Accordingly, the WP was disposed off in September 2017.
However, till date, the application has not been decided.
“The years period for consideration of the application for reconstruction of his residential house cannot be considered as reasonable by any administrative standards. Non-consideration of the application is not only breach of the order but shows nonperformance of public duties, for which a disciplinary action is also contemplated,” Court observed.
