The recent news expressing concern over the rise in pending cases in Goa due to delayed hearings has once again sparked public debate. However, any fair and informed discussion must begin by acknowledging one undeniable truth the judiciary, far from being the cause of the problem, remains its strongest pillar of resilience.
Judges today are functioning under extraordinary pressure, handling an ever increasing influx of cases with remarkable dedication and discipline. The rise in pendency is not a consequence of inaction, but rather a reflection of the overwhelming burden placed upon a limited number of judicial officers who continue to perform their duties with unwavering commitment.
Every hearing that takes place in a courtroom is not a mere procedural formality. Judges invest immense time and patience in ensuring that each party is heard fully and fairly. What may be perceived as delay is, in reality, a conscious and commendable effort to uphold the principles of natural justice. Rushed hearings may reduce numbers, but they risk compromising justice, something the judiciary steadfastly refuses to do.
It is also important to recognize that judges are constantly balancing competing pressures. On one hand, there is a legitimate expectation for speedy disposal of cases, on the other, there is a constitutional obligation to deliver well reasoned, legally sound judgments. The fact that judges consistently prioritize quality over haste is not a weakness, but a testament to their integrity and sense of duty.
The challenges they face go far beyond the courtroom. With shortages in judicial strength, infrastructural limitations, and procedural complexities, judges often find themselves working late into the evening, long after court hours have ended. Their work does not stop when the court rises, if anything, that is when the most intellectually demanding part begins, analyzing evidence, researching legal principles, and drafting detailed orders.
Moreover, delays in hearings are frequently caused by factors entirely outside judicial control, adjournments sought by parties, absence of witnesses, procedural requirements, and logistical constraints. Despite these hurdles, judges continue to maintain order, ensure fairness, and move cases forward to the best of their ability.
Particularly noteworthy is the sensitivity shown by judges in matters where individuals are in custody. In such cases, they carry an added moral responsibility to expedite proceedings without compromising justice. This delicate balance requires not only legal acumen but also a deep sense of humanity, qualities that our judges demonstrate every single day.
It must also be remembered that judges are not immune to personal challenges. They, too, have families, responsibilities, and personal hardships. Yet, they rise above these and continue to serve with dignity, impartiality, and an unshakable commitment to justice. Their ability to maintain composure and clarity under such demanding circumstances is truly commendable.
In many ways, the rising number of cases is also a sign of increasing public faith in the judiciary. More people are turning to courts for redressal, trusting that their grievances will be heard and decided fairly. This trust is not misplaced, it is earned daily through the tireless efforts of judges who remain steadfast in their duty.
Therefore, while concerns about pendency and delays deserve attention, they must not overshadow the extraordinary contribution of the judiciary. Judges are not the cause of delay, they are the very reason the system continues to function despite immense strain. In Goa, new judges are appointed to strengthen the judiciary. Once appointed, they undergo structured training to equip them with the necessary skills and knowledge to handle diverse and complex matters across various branches of law. The newly appointed judges are currently undergoing training, and once they return, the issue would ease out to an extent.
In conclusion, the narrative must shift from criticism to appreciation. The judiciary in Goa, like elsewhere, stands as a symbol of perseverance, integrity, and dedication. Judges are not merely resolving disputes, they are upholding the rule of law, protecting rights, and ensuring that justice prevails, even in the face of overwhelming challenges.
