Panaji: After participating in a symbolic walk in Panaji for “Mediation Awareness,” Chief Justice of India Surya Kant on Friday said that mediation is being accepted as a successful, cost-effective and win-win situation for both parties.
The CJI on Friday participated in a symbolic “Mediation Awareness Walk” near Kala Academy in Panaji ahead of the inauguration of the conference titled Mediation: How Significant in the Present-Day Context, organised by the India International University of Legal Education and Research (IIULER) at Sancoale village in South Goa, scheduled to be held later in the day.
“Mediation is being accepted as successful and cost-effective. It is a win-win situation for both parties as it leads to a settlement,” he said.
The CJI said that it results in a settlement to the entire satisfaction of both parties. “In mediation, none of the mediators impose anything on the parties; it is only what they desire or what they want. Only then is the give-and-take policy adopted,” he said.
The CJI said that the Supreme Court had launched the “Mediation for Nation” initiative with the idea of sending a message throughout the country.
“Not only to the consumers of justice but also to direct stakeholders like the Bar and the Bench,” he said.
Kant said that if people sensitise themselves and become conscious of the fact that mediation is a successful tool, it will lead to good results. “This has actually happened. We were able to persuade High Courts and District Courts to identify certain matters which can be sent for mediation,” he said.
The CJI said that mediation is an ongoing process and will never come to an end.
“It will continue for old cases as well as fresh ones. It will also continue at the pre-litigation stage, even before a case is taken to court,” he added.
