Panaji: Goa Bench of Bombay High court on Wednesday set aside the order of Additional Sessions Judge which had cancelled bail of Aam Aadmi Party Goa President Amit Palekar, accusing of violating the bail condition.
The single bench comprising Judge B P Deshpande on Wednesday set aside the order by Additional Sessions Judge Apurva Nagvekar, Panaji sitting at Ponda town which had cancelled the bail granted to Palekar, in connection with a road accident case.
The sessions court had cancelled his bail on Monday following which Palekar had appealed before the HC. The case was heard on Wednesday.
Advocate Nitin Sardesai, representing Palekar, told reporters that the HC while setting aside the order, said that the judgment of the district court was “highly obnoxious.”
He said that the Bench stated that such order ought not to have been passed and unfortunately, there is gross non application of mind.
The crime branch had moved an application to cancel bail of Palekar contending that he had violated the bail condition by travelling abroad. The investigating agency said that the court had granted him permission to travel to France but he also went to other countries.
Sardesai said that one of the Principle of law is that you are not supposed to read in the order. “It is to job of anybody to add or subtract anything from the order,” he said.
Three persons were killed on August 6, 2023, when a speeding Mercedes car hit multiple vehicles on Banastarim bridge near Panaji. At the time, the Crime Branch had arrested Palekar for allegedly tampering with evidence and trying to produce a decoy driver to protect the accused Paresh Sawardekar who was allegedly at the wheel.
