Mapusa: The Court on Friday rejected the anticipatory bail petition filed by Saurabh Luthra and Gaurav Luthra, who are already in the Judicial custody in connection to the Birch by Romeo Lane, Arpora fire case.
At least 25 people had died in the fire that engulfed the club at Arpora in December last year. The club was owned by Luthra brothers, who were arrested in Thailand after they tried to flee from the country.
While they were being investigated by Anjuna police in connection with the fire, Mapusa police in North Goa had filed a case of forgery against both the brothers, accusing them of providing forged documents to obtain Excise licence.
Advocate Parag Rao, representing both the accused, said that they had filed anticipatory bail petition before Additional Sessions court in Mapusa, which was rejected on Friday.
Advocate Rao told reporters in Mapusa that the Judget has has announced the order that both the anticipatory bails are rejected.
“We are yet to get the detailed judgment. We have to go through the order. We were not expecting it to be rejected,” he said.
Advocate Rao pointed out that another owner of Birch by Romeo Lane, Ajay Gupta has been bailed out by the court giving him bail even in the same forgery case filed against him by Mapusa police.
The lawyer said that Luthra Brothers had had argued that the alleged false documents are with the police so they don’t require the custody of my clients.
He said that his clients had not applied for any documents which are now claimed to have been forged.
The Health officer of Candolim Health Centre (North Goa) had filed a case against Luthra Brothers claiming that they had forged his signature to create fake NOC which was submitted to the Excise Department to get licence for Birch by Romeo Lane night club at Arpora.
